These Terms of Service ("Terms") govern your access to and use of the storefront, content, and products offered by [LEGAL ENTITY NAME] ("True American Pets," "TAP," "we," "us," or "our"), including our dog collars, leashes, and bandanas. When you purchase through a marketplace, that platform's own terms, conditions, and policies (for example, Amazon's Conditions of Use or the TikTok Shop terms) also apply and will control over these Terms to the extent of any conflict on that platform. These Terms govern your relationship with TAP as the seller of the products.

4. Products, descriptions, and pricing

We offer dog collars, leashes, and bandanas. We work to display product colors, sizes, and details accurately, but actual products may vary slightly due to materials, screen settings, and manufacturing tolerances. Prices are shown in U.S. dollars and may change at any time. We may limit quantities, correct errors, and refuse or cancel any order, including after an order has been placed.

5. Orders and payment

Your order is an offer to buy. We accept your order when we dispatch the product (or, on a marketplace, as that platform defines acceptance). Payment is processed by Shopify, our payment processors, or the applicable marketplace; we do not receive or store your full payment card details.

6. Shipping, returns, and refunds

Shipping timelines, returns, and refunds depend on the channel you purchased through. Orders placed on Amazon or TikTok Shop are subject to those platforms' shipping and return policies. For orders on our own store, our posted shipping and return terms and Shopify's hosted checkout flow apply.

7. Product safety and proper use

Our collars, leashes, and bandanas are pet accessories and restraint aids — not guaranteed escape-proof or indestructible devices. You agree to use them responsibly:

• Choose the correct size and strength for your dog, and check fit using the two-finger rule (you should be able to fit two fingers between the collar and your dog's neck).
• Inspect hardware for wear before each use and retire any item that is frayed, cracked, or damaged.
• Do not use a collar or leash to tie up or tether a dog unattended.
• Bandanas can pose a choking or strangulation hazard. Never leave a bandana on an unsupervised dog, ensure it can come free if snagged, and do not let your dog chew or swallow it. Bandanas are not toys.
• These products are not a substitute for proper training, supervision, or veterinary care.

You assume responsibility for selecting the right product and using it safely for your dog.

8. Limited warranty

We warrant our products against defects in materials and workmanship under normal use for a period of [WARRANTY PERIOD] from delivery. Your sole remedy under this limited warranty is, at our option, replacement of the product or a refund of the purchase price. This warranty does not cover normal wear and tear, chewing or other damage caused by a pet, misuse, improper sizing, accidents, or alterations.

To the fullest extent permitted by law, TAP will not be liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to a product or order will not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless TAP and its officers, employees, and agents from any claims, damages, or expenses arising out of your misuse of our products or your violation of these Terms.

12. Intellectual property and the Sgt. Stubby notice

Our logos, brand name, original designs, artwork, photography, and store content are the property of TAP or our licensors and are protected by intellectual property laws. You may not copy or use them without our permission.

Sgt. Stubby is in the public domain. Sgt. Stubby was a real World War I service dog who died in 1926. He is a historical figure in the public domain, and TAP claims no ownership of the historical name, story, or factual history of Sgt. Stubby. We reference him only as a tribute to American service animals and the heroes they served alongside.

TAP is an independent company. We are not affiliated with, sponsored by, or endorsed by the U.S. Army, the U.S. government, the Smithsonian Institution, or any veterans' organization, and no such affiliation or endorsement is implied.

Note: while the historical figure and facts about Sgt. Stubby are public domain, specific modern depictions, films, or artworks created by third parties may carry their own rights. TAP's own original artwork remains TAP's property.

13. User content

If you submit reviews, photos, or other content, you grant TAP a non-exclusive, royalty-free license to use, display, and reproduce it in connection with our business. You agree not to submit content that is unlawful, infringing, or harmful.

14. Marketplace-specific terms

Purchases made through Amazon USA or TikTok Shop USA are also subject to those marketplaces' terms, conditions, and policies. We are not responsible for the operation, content, or conduct of those platforms.

15. Governing law and disputes

These Terms are governed by the laws of the State of [GOVERNING-LAW STATE], without regard to its conflict-of-laws rules, and any dispute will be resolved in the state or federal courts located there, unless otherwise required by law.
